The Wicklow-Wexford TD was stopped at a mandatory checkpoint in Dublin City Centre last May.
Fianna Fáil Deputy Malcolm Byrne has appeared in court, accused of drink-driving over the summer.
The Wicklow-Wexford TD faces a single charge that on 28th May, at Pearse Street Garda station, the concentration of alcohol in his urine was 156 milligrams of alcohol per 100 millilitres. That exceeds the statutory limit of 67 milligrams.
The offence is punishable by a fine of up to €5,000 and/or a maximum six-month jail term.
The 52-year-old, of Ramsgate Village, Gorey, Co Wexford, appeared at Dublin District Court before Judge Tom McSharry. In an earlier statement, Deputy Byrne said Gardaí arrested him at a mandatory checkpoint in the city centre while he was travelling from a hotel in Dublin to Dublin Airport.
The Fianna Fáil Deputy has not yet entered a plea. It was the first date the matter was before the court.
Council sought an order for disclosure of the prosecution's evidence. Judge McSharry acceded to the request and ordered compliance by 27th February next, telling prosecuting Garda Anna Murphy to hand over the material to Mr Byrne's solicitor.
The hearing has been scheduled for 23rd March 2027.
