Wicklow County Council are facing a challenge after denying planning permission for a holiday resort near Magheramore Beach.
The Oakmount company has called for An Bord Pleannala to reverse the decision and allow the development of a boutique hotel and Surf School to go ahead.
Martin Dyer launched a petition against the project online.
He says the appeal doesn't come as a surprise.
